Terms and Conditions

By purchasing, registering for, enrolling in, accessing, or participating in any workshop, course, subscription, digital resource, clinic, event, or other offering provided by Ascent Track Clinics LLC (“Ascent Track”), you agree to the following Terms & Conditions.

1. Registration and Account Information

You agree to provide accurate and current information when registering or creating an account. Access to purchased or registered offerings is intended for the individual registrant unless otherwise expressly stated by Ascent Track.

2. Payment and Pricing

All prices are shown at the time of purchase and are subject to change for future purchases. You authorize Ascent Track and its payment processors to charge the payment method provided for the amount displayed at checkout.

For any subscription or automatically renewing offering, the applicable price, billing frequency, renewal terms, and cancellation terms will be disclosed separately at the time of enrollment. Your acceptance of these Terms does not, by itself, constitute consent to recurring charges.

Persons under the age of 18 should use this website only with the supervision of an Adult. Payment Information must be provided by or with the permission of an Adult.

3. Refunds, Cancellations, and Transfers

Refunds, cancellations, credits, and registration transfers are subject to the specific refund or cancellation policy displayed for the applicable offering at the time of purchase. Unless otherwise stated, failure to attend or participate does not automatically entitle a registrant to a refund.

Ascent Track reserves the right to cancel, postpone, reschedule, modify, or substitute elements of an offering when reasonably necessary. If Ascent Track cancels an offering entirely, registrants will receive the remedy specified in the applicable cancellation policy.

4. Workshop and Event Recordings

Certain workshops, courses, meetings, live sessions, community events, clinics, or other Ascent Track offerings may be recorded.

When access to a recording is included with registration or purchase, the recording will be made available to authorized participants for the period specified by Ascent Track. Recording availability, posting time, and length of access may vary by offering.

Access to recordings is for the registered user’s personal educational use only. Recordings may not be copied, shared, redistributed, republished, sold, publicly displayed, or otherwise made available to others unless Ascent Track Clinics LLC provides written permission.

Ascent Track does not guarantee that every live offering will be recorded or that recordings will remain available indefinitely unless specifically stated as part of the offering.

5. Photography, Video, and Audio Recording Consent

By attending or participating in any in-person or virtual Ascent Track Clinics LLC event, clinic, workshop, course, meeting, community session, or other offering, you acknowledge that photography, video recording, and/or audio recording may occur.

You grant Ascent Track Clinics LLC permission to photograph, film, record, and otherwise capture your image, likeness, voice, comments, participation, and appearance during Ascent Track offerings, and to use those materials for educational, promotional, marketing, archival, social media, website, and other legitimate business purposes.

You understand that these materials may be edited, reproduced, published, distributed, displayed, or otherwise used by Ascent Track Clinics LLC without additional compensation, unless otherwise prohibited by law.

If you do not wish to be photographed or recorded at an in-person event, you should notify Ascent Track staff before the event begins. Ascent Track will make reasonable efforts to accommodate such requests, although it may not be possible to guarantee complete exclusion from background or crowd images.

For virtual offerings, participants who choose to use their camera, microphone, chat, comments, or other interactive features acknowledge that their contributions may be included in a recording of the session.

6. Intellectual Property and Permitted Use

All presentations, recordings, videos, written materials, worksheets, training documents, graphics, course content, and other materials provided by Ascent Track or its Lead Coaches, instructors, speakers, or contributors are protected intellectual property.

Unless Ascent Track expressly provides written permission, you may not reproduce, record, download where downloading is not enabled, copy, distribute, publish, upload, share, sell, sublicense, publicly display, or otherwise make Ascent Track materials available to other individuals or organizations.

Purchased access is for the registrant’s personal educational use only.

You may use ideas and information learned through Ascent Track in your own coaching, teaching, training, or professional practice, but you may not redistribute or commercially reproduce the underlying Ascent Track materials.

7. Community Conduct and Acceptable Use

Participants and users are expected to engage respectfully, professionally, and constructively across all Ascent Track offerings and platforms, including workshops, courses, Coaching Studios, community areas, message boards, comments, live sessions, video discussions, and other interactive features.

Users may not harass, threaten, demean, impersonate, or target others; post unlawful, abusive, discriminatory, defamatory, sexually explicit, or otherwise inappropriate content; spam or promote unrelated products or services; disrupt discussions or live sessions; misuse another person’s personal information; improperly share access credentials or protected materials; or upload or distribute content that infringes the rights of others.

Ascent Track may review, moderate, hide, remove, or restrict access to comments, posts, videos, messages, or other user-submitted content that violates these standards or otherwise interferes with the experience of other participants. Ascent Track may also suspend or terminate access to any offering or community feature for serious or repeated misconduct.

Removal of content, suspension, or termination for misconduct may occur without refund where permitted by law.

8. Athletic, Training, and Mental Performance Information

Information provided through Ascent Track offerings concerning exercise, training, technique, strength and conditioning, rehabilitation, athletic performance, mental performance, sport psychology, motivation, confidence, focus, stress management, or related topics is provided for educational and informational purposes only.

Such information is not a substitute for individualized medical, psychological, psychiatric, therapeutic, or other professional healthcare advice, diagnosis, or treatment. Participation in an Ascent Track offering does not create a doctor-patient, therapist-client, psychologist-client, or other clinical treatment relationship with Ascent Track Clinics LLC or any Lead Coach, instructor, speaker, or contributor.

Participants are responsible for determining whether particular exercises, training methods, mental-performance strategies, or other techniques are appropriate for themselves or for individuals they coach. Anyone with questions or concerns regarding a medical or mental health condition should consult an appropriately qualified healthcare or mental health professional.

9. Technology and Online Access

For online offerings, participants are responsible for having appropriate internet access, equipment, software, and other technology necessary to participate.

Ascent Track is not responsible for interruptions or access problems caused by a participant’s equipment, internet connection, third-party software, or other circumstances outside Ascent Track’s reasonable control.

10. Third Party Platforms and Resources

Some Ascent Track offerings may use third-party services or platforms, including learning-management systems, video-conferencing platforms, payment processors, cloud-based documents, or other online tools. Use of those services may also be subject to the third party’s own terms and privacy practices.

11. Communications

By registering, you may receive transactional communications necessary to administer your purchase or participation, such as registration confirmations, access instructions, scheduling information, reminders, and recording notices. Marketing email or text-message communications are governed by any separate consent or subscription choices presented to you. Providing a telephone number does not, by itself, constitute consent to receive marketing text messages.

12. Privacy

Personal information collected through registration, checkout, or participation will be handled in accordance with Ascent Track’s Privacy Policy and applicable law.

13. Changes to Offerings

Ascent Track may reasonably modify schedules, formats, Lead Coaches, instructors, presenters, curriculum, platforms, locations, or other logistical elements when circumstances require. Material changes will be communicated to registered participants when practicable.

14. Limitation of Liability

To the fullest extent permitted by applicable law, Ascent Track Clinics LLC and its owners, employees, contractors, Lead Coaches, instructors, speakers, and affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages arising from participation in or use of an Ascent Track offering.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

15. Governing Law

These Terms will be governed by the laws of New York State, without regard to conflict-of-law principles, except where applicable consumer-protection law requires otherwise.

16. Changes to These Terms

Ascent Track may update these Terms from time to time. The version presented and accepted at the time of a transaction or enrollment will apply to that transaction unless otherwise required by law.

18. Changes to the Facilities and these Terms and Conditions

We reserve the right to change the Website, its Content or these Terms and Conditions at any time. You will be bound by any changes to the Terms and Conditions from the first time you use the Website following the changes. If We are required to make any changes to these Terms and Conditions by law, these changes will apply automatically to any orders currently pending in addition to any orders placed by you in the future.

19. Availability of the Website

The Website is provided “as is” and on an “as available” basis. Ascent Track uses industry best practices to provide a high uptime, including a fault-tolerant architecture hosted in cloud servers. We give no warranty that the Website or Facilities will be free of defects and / or faults and we do not provide any kind of refund for outages. We provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality.

We accept no liability for any disruption or non-availability of the Website resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.
